단기 체류 신청인을 위한 신체검사 절차 개정

 

개정된 절차

주한캐나다대사관은 최근 변경된 제도에 따라 2011년 5월 1일부터 단기 체류 신청인에게 적용되는 입국 신체검사 절차를 재편하였습니다.

주요 변경 사항으로서 입국 신체검사가 요구되는 단기 체류 신청인은 반드시 주한캐나다대사관에 신청서를 먼저 제출해야 합니다.

주한캐나다대사관은 신청서를 접수하는 즉시 신체검사 지시서와 신체검사서 양식(IMM 1017)을 관련 세부 안내서와 함께 신청인에게 이메일로 발송합니다.

다음 단계로 신청인은 10영업일 또는 2주 이내에 입국 신체검사를 받아야 합니다.

이러한 제도 개정을 통해 업무 중복을 피하고 심사에만 집중할 수 있으므로 신청인을 위한 서비스 개선과 수속 기간 단축이 예상됩니다.

이번에 개정된 제도는 2011년 1월 이래로 2,000명 이상의 워킹 홀리데이 프로그램 참가자를 대상으로 한 시범 적용을 통해 검증을 마쳤습니다. 신속히 처리된 경우 신체검사를 받은 날로부터 3일 만에 승인 절차가 완료된 바 있습니다.

개정된 신체검사 절차를 적용받기를 원하는 유학생, 취업자, 임시 거주자는 신체검사 이외의 다른 모든 요건이 충족되는 대로 유학 허가증, 취업 허가증, 또는 임시 거주 비자를 신청해야 합니다. 또한, 단기 체류 신청인은 반드시 신체검사 지시서에 명시된 5개 지정 병원 중 1곳에서 신체검사를 받아야 합니다.

개정된 절차는 ‘이민 및 난민 보호법’ 제16(2)(b)항과 ‘이민 및 난민 보호 규정’ 제30조에 따라 입국 신체검사가 요구되는 모든 유학생, 취업자, 또는 임시 거주자에게 적용됩니다.

‘이민 및 난민 보호 규정’ 제30(1)(c)항은 또한 6개월 이상 연속으로 캐나다에 체류하기를 희망하는 외국 국적자가 캐나다 입국 희망일로부터 직전 1년 기간 중에 6개월 이상 연속으로 지정 국가에서 거주 또는 체류한 경우 반드시 신체검사를 받아야 한다고 규정하고 있습니다.

제출 서류 

개정된 신체검사 절차를 적용받기 위해 신청인에게 추가로 요구되는 서류 제출 요건은, 캐나다대사관에 신청서를 제출하기에 앞서, 여권 신상 정보(사진) 페이지와 주민등록증의 선명한 컬러 사본을 2부 준비하는 것입니다.

사본 1부는 유학 허가증, 취업 허가증, 또는 임시 거주 비자 신청서와 함께 캐나다대사관에 제출해야 합니다. 나머지 1부는 신체검사 지정 병원에서 입국 신체검사를 실시할 때 신청인의 여권 또는 주민등록증 원본을 제시하여 본인 여부를 확인할 목적으로 요구되므로 반드시 신청인이 소지해야 합니다.

보다 세부적인 서류 제출 요건은 유학생, 취업자, 또는 임시 거주자 체크리스트를 참고하시기 바랍니다.

 

과도기 규정

2011년 5월 1일부터 주한캐나다대사관은 입국 신체검사가 요구되는 단기 체류 신청인으로부터 신청서를 접수하는 즉시 신체검사 지시서와 신체검사서 양식(IMM 1017)을 관련 세부 안내서와 함께 이메일로 발송하기 시작했습니다.

신체검사 지정 병원들 역시 2011년 5월 1일부터 신체검사 지시서와 신체검사서 양식(IMM 1017)을 수령한 신청인의 예약에 따라 개정된 절차를 적용하기 시작했습니다.

5월 31일 이후부터, 신체검사 지정 병원은 주한캐나다대사관에 신청서를 제출 후 신체검사 지시서와 신체검사서 양식(IMM 1017)을 수령한 신청인이 아닌 경우 신체검사를 실시하지 않습니다. 다만, 주한캐나다대사관은 2011년 5월 31일 이전에 입국 신체검사를 받은 신청인에 한해 종전처럼 신청서를 접수합니다.

중요한 변경 사항으로서 2011년 5월 31일 이후에는 신청인이 주한캐나다대사관에 신청서를 제출했다는 증빙이 없는 경우 관할 캐나다 신체검사 사무국(Regional Medical Office/RMO)에서는 입국 신체검사 심사를 수행하지 않습니다. 즉 2011년 5월 31일 이후에는 신청서 제출 없이는 신체검사를 받을 수 없습니다.

 

주의

입국 신체검사와 관련된 일체의 수속료는 신청인이 부담합니다.

신체검사 지정 병원은 신청인의 신체검사 결과를 관할 캐나다 RMO에 이메일, 팩스 및/또는 택배로 직접 발송합니다. 신청인은 신체검사 관련 내용을 주한캐나다대사관이나 캐나다 RMO로 직접 송부하지 마십시오.

신청인은 본인의 신체검사 결과를 확인할 수 있는 권리가 있습니다.

본인의 입국 신체검사 결과가 이메일이나 팩스로 발송되는 것에 동의하지 않는 경우에는 입국 신체검사를 받는 신체검사 지정 병원에 그러한 의사를 전달하시기 바랍니다. 이 경우 신청서 수속 절차가 지연될 수 있습니다.

신청인에게 신체검사 지시서가 발급되었다고 해서 신청서가 승인되는 것은 아닙니다. 최종 결정이 내려지기 전까지는 신청서와 관련하여 어떠한 사항도 확정하지 마십시오.

신체검사 확인증 또는 입국 신체검사 결과는 검사일로부터 최장 12개월간 유효하며 연장이 가능한 경우는 거의 없습니다.

신청인이 신체검사를 받고 원본 신체검사서 양식을 제출한 이후에 추가 검사나 재검을 요구 받을 수도 있습니다.

신청인의 동반 가족들도 동일한 신체검사 지정 병원에서 신체검사를 받아야 합니다. 신청인 본인 또는 동반 부양 가족이 해외에 체류하고 있는 까닭에 국내 신체검사 지정 병원을 방문할 수 없는 경우에는 대사관에 관련 내용을 문의하시기 바랍니다. 이 경우 신청서 수속 절차가 지연될 수 있습니다.

IMPORTANT CHANGE NEW MEDICAL EXAMINATION PROCEDURES FOR TEMPORARY RESIDENTS

 

New procedures

In light of recent system changes, the Canadian Embassy in Korea has streamlined the immigration medical examination process ftemporary residents since May 1, 2011.

The key change is that prospective temporary residents who require an immigration medical examination must first submit their application to the Canadian Embassy.

Immediately on receipt, the Canadian Embassy will send medical instructions the Medical Report Form (IMM 1017) with all relevant client details by e-mail.

Clients then have ten (10) working days two (2) weeks to complete their immigration medical examination.

This new system should improve client service speed up processing, as it enables us to eliminate duplication of effort to focus on assessing cases.

This new system is tried tested, in that it was implemented starting in January 2011 with over 2,000 working holiday programme applicants. The first cases were approved three (3) days after the applicants completed their immigration medical examination.

In order to benefit from the new medical examination procedures, prospective students, workers, temporary residents must simply apply fa study permit, work permit, temporary resident visa as soon as all other non-medical requirements are met. In addition, prospective temporary residents must be examined at one of the five (5) Designated Medical Centres contained in the medical instructions.

These new procedures apply to all prospective students, workers, temporary residents who require an immigration medical examination in order to comply with Paragraph 16(2)(b) of the Immigration Refugee Protection Act Section 30 of the Immigration Refugee Protection Regulations.

The most relevant provision is Paragraph 30(1)(c) of the Immigration Refugee Protection Regulations, which spells out that foreign nationals seeking entry into Canada fmore than six consecutive months who have resided sojourned fsix consecutive months in a designated country during the one-year period immediately preceding the date of seeking entry to Canada, require a medical examination.

Document requirements

The only additional document requirement fapplicants to benefit from the new medical examination procedures is that each applicant must make two (2) high quality colour copies of their passport biographical data (photo) page of their Resident Registration Card, before submitting their application to the Canadian Embassy.

The first copy must be submitted with the study permit, work permit, temporary resident visa application to the Canadian Embassy. The second copy must be retained by the applicant, as it will later be required by the Designated Medical Centre to certify the identity of the applicant using either the passport the Resident Registration Card at the time of the immigration medical examination.

Transitional provisions

Since May 1, 2011, the Canadian Embassy has started sending medical instructions the Medical Report Form (IMM 1017) with all relevant client details by e-mail to clients, immediately on receipt of an application from prospective temporary residents who require an immigration medical examination.

Designated Medical Centres have also begun to use these procedures effective May 1, 2011, on receipt of a fan appointment from an applicant who has received the medical instructions the Medical Report Form (IMM 1017).

Designated Medical Centres will not accept to medically examine any clients other than those who have submitted an application to the Canadian Embassy who have received medical instructions the Medical Report Form (IMM 1017), after May 31, 2011. The Canadian Embassy will also continue to accept applications from prospective applicants who have taken the immigration medical exam on before May 31, 2011.

One key difference, after May 31, 2011, is that the Canadian Regional Medical Office will not complete the immigration medical assessment without proof that the applicant has submitted an application to the Canadian Embassy in Seoul. In other words, after May 31, 2011, there will be no more medical examination without application.

 

Notes

Any all fees related to the immigration medical examination are the responsibility of the applicant.

The Designated Medical Centre will send the results of your immigration medical examination directly to the Canadian Regional Medical Office by e-mail, fax, and/courier. Do not send this information to the Canadian Embassy in Seoul to the Canadian Regional Medical Office directly.

Applicants are entitled to know the results of their medical examination.

If you do not agree to have your immigration medical information sent by e-mail fax, inform the Designated Medical Centre at the time of your immigration medical examination. In this case, expect delays in the processing of your application.

The issuance of medical instructions does not constitute acceptance of your application. You should not make any commitments related to the application until a final decision has been taken.

Medical certificates immigration medical results are valid fa maximum of 12 months from the date of examination extensions are rarely possible.

It is possible that after the completion of your medical examination submission of original reports, further tests reports may be ed.

Family members should be examined at the same Designated Medical Centre. If you any of your dependants are outside of Korea cannot attend one of the Designated Medical Centres in Korea, contact us ffurther instructions. In this case, expect delays in the processing of your application.
